SWD Provider — Privacy Policy

Southwest Domestics, Inc. ("Southwest Domestics," "we," "us," or "our") operates the SWD Provider mobile application (the "App"), a marketplace network connecting independent in-home care providers with Texas families seeking domestic services. This Privacy Policy describes how we collect, use, and share your information when you use the App.

1. Information We Collect
1.1 Information you provide directly
- Account & contact: phone number, full legal name, email address, preferred language, mailing address, date of birth
- Profile & application: photograph, years of experience, age groups worked with, certifications, languages spoken, days available, hours preferred, hourly rate request, vaccination status, smoking status, references (names + phone numbers), origin/birthplace
- Identity verification: government-issued ID image (driver's license, state ID, or passport) and extracted fields (name, date of birth, address, ID number, issuing state, expiration date)
- Background check authorization: your electronic signature, the date/time of signature, and your acknowledgment of FCRA disclosures
- Communications: messages you send to the Southwest Domestics office through the in-app chat
- Payment information: bank routing information for direct deposit of compensation (collected outside the App when applicable)
1.2 Information collected automatically
- Device & app info: device model, iOS version, App version, language setting, push notification token
- Location data: when you accept an engagement with a Client, the App records when you arrive at and leave the Client's home address (a geofence event). This information is used to create a service-verification record and is described in detail in Section 3 below.
- Usage analytics: events related to App functionality (e.g., onboarding step completion, sign-in events) collected via Sentry for crash reporting and diagnostic purposes. Personal identifiers are not included in diagnostic events.
1.3 Information from third parties
- Background check results: when you authorize a background check, we receive the results from our Consumer Reporting Agency (CRA), Checkr, Inc. These results may include criminal history, motor vehicle records, and verification of identity.
2. How We Use Your Information
We use your information for the following purposes:
- To create and maintain your provider profile
- To match you with engagement opportunities from Texas families
- To verify your identity through automated optical character recognition (OCR) of your government-issued ID
- To facilitate background check authorization and transmit your information to the CRA (Checkr)
- To create a verifiable record that services were rendered when you accept and perform an engagement at a Client's home
- To communicate with you about your account, engagements, and the App
- To send push notifications regarding new opportunities, interview confirmations, and chat messages
- To respond to your questions sent through in-app chat
- To improve the App through diagnostic and crash-report data
- To comply with legal obligations (tax reporting, court orders, regulatory inquiries)
3. Location Data — Detailed Disclosure
When you use the App, we collect location information in two specific contexts:
3.1 Texas service-area check (foreground only)
When you open the App, we briefly read your GPS coordinates to confirm you are within the State of Texas. Southwest Domestics operates exclusively in Texas. The result is stored as a yes/no answer, not a precise location trail.
3.2 Service verification (geofence-based, only while engaged)
When you accept an engagement with a Client and the engagement begins, the App creates a geofence around the Client's home address. Your iPhone detects when you enter and exit this geofence and reports those events to our servers. Geofence events are timestamped and used to create a record that services were rendered.
Permitted uses of location data:
- Confirming you are within the Texas service area
- Maintaining a service-verification record for the duration of each engagement
Uses NOT permitted:
- Billing or hours tracking (your reported hours remain the primary pay record)
- Scheduling decisions
- Sharing your location with Clients or any third party
- Advertising or marketing
- Building a continuous movement history outside geofence boundaries
- Cross-app tracking
Why "Always" permission is required: iOS does not deliver background geofence events to the App unless your Location permission is set to "Always Allow." This is an Apple operating-system requirement, not a Southwest Domestics requirement.
Your control: You may revoke location access at any time via iOS Settings → SWD Provider → Location. The App will not function in service-verification mode without location access.
4. How We Share Your Information
We share your information only with the following categories of recipients, and only for the purposes described:

We do not sell your personal information. We do not share your information with advertising networks. We do not use your information for cross-app tracking.
We may disclose your information when required by law, in response to subpoenas or court orders, or to protect our legal rights.
5. How Long We Keep Your Information
- Account & profile information: retained as long as your account is active. After you delete your account, basic record-keeping information may be retained for up to 7 years for compliance with tax, accounting, and regulatory requirements.
- Government-issued ID images: retained for the duration of your engagement with Southwest Domestics, then archived.
- Geofence event records: retained for 4 years (consistent with TWC recordkeeping requirements).
- Chat messages: retained as long as your account is active.
- Diagnostic events: 7-day rolling window.
6. Your Rights
You have the right to:
- Access the personal information we hold about you
- Correct inaccurate information about you (most fields are editable in the App via Settings → Profile)
- Delete your account by going to Settings → Delete Account in the App
- Receive a copy of your data on request — contact us at the address above
- Pause your account temporarily via Settings → Pause Account
- Withdraw consent for the background check at any time (note: this may end your engagement with Southwest Domestics)
- Object to specific processing — contact us to discuss
7. Children's Privacy
The App is not directed at children under the age of 18, and we do not knowingly collect personal information from minors. You must be 18 or older to apply to be a Provider.
8. Data Security
We implement administrative, technical, and physical safeguards designed to protect your personal information, including:
- Encryption of data in transit (TLS 1.2+)
- Encryption of sensitive documents at rest
- Restricted access to personal information on a need-to-know basis
- Industry-standard authentication (SMS one-time passcodes + JWT)
No security measure is perfect. If we become aware of a breach of your personal information, we will notify you in accordance with applicable law.
9. Texas Residents — Specific Rights
Under Texas law, residents have certain rights regarding their personal information. You may request access to, correction of, or deletion of your personal information by contacting us at info@southwestdomestics.org. We will respond within 45 days of receiving a verified request.
10. California Residents
If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what categories of personal information we collect and disclose, the right to delete your information, and the right to opt out of the sale of personal information. We do not sell personal information.
11. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you in the App and update the Effective Date above. Your continued use of the App after changes take effect constitutes acceptance of the updated policy.
